Terms of service

Last updated: August 18, 2026

1. Overview

Welcome to AmberSole. These Terms of Service ("Terms") govern your access to and use of the AmberSole website, online store, and any related services (collectively, the "Services").

AmberSole operates as an online retailer offering footwear and related products to customers in Europe. Unless otherwise stated at checkout, prices and transactions are displayed and processed in euros (EUR / €).

By visiting our website, browsing our products, creating an account, or placing an order, you agree to these Terms together with any policies referenced or linked on our website, including our Privacy Policy, Returns & Refund Policy, and Shipping Policy.

Nothing in these Terms is intended to exclude, restrict, or replace any mandatory consumer rights available to you under applicable European Union or national law.

If you do not agree to these Terms, you should not use our Services.

2. Eligibility

By using our Services or placing an order, you confirm that you have the legal capacity required to enter into a purchase contract under the laws applicable to you.

If you are under the age at which you may legally enter into contracts independently in your country of residence, you may use the Services only with appropriate parental or legal guardian involvement where required by law.

You may not use the Services or products for any unlawful or unauthorised purpose or in a manner that violates applicable laws or regulations.

3. Online Store Terms

We reserve the right to refuse, restrict, or cancel access to our Services where we have a lawful and legitimate reason to do so, including suspected fraud, misuse, security threats, or violations of these Terms.

You agree not to reproduce, duplicate, copy, sell, resell, exploit, scrape, or commercially use any portion of our website or Services without our prior written permission, except where such restriction would be prohibited by applicable law.

You must not interfere with the normal operation, security, or integrity of our website.

4. Products, Pricing, and Availability

All products displayed on our website are subject to availability.

We may limit quantities, withdraw products, or change our product range at any time before an order is accepted, subject to applicable consumer law.

Prices are generally displayed in EUR (€) and include or exclude applicable taxes as indicated during checkout and as required by applicable law.

Any applicable shipping charges or other mandatory costs will be displayed before you place your order.

We make reasonable efforts to display product photographs, colours, descriptions, sizing information, and specifications accurately. However, colours may appear differently depending on your screen, device, lighting, or display settings.

Prices may change from time to time. Any change will not affect an order that has already been accepted unless otherwise required or permitted by law.

5. Product Information

Customers are responsible for reviewing the product description, photographs, sizing information, and other information made available on the relevant product page before placing an order.

Some products may be manufactured in different production batches. As a result, minor variations may occur in areas such as:

  • Colour tone;
  • Stitching;
  • Texture;
  • Packaging;
  • Internal labels;
  • Decorative details;
  • Finishing.

Minor variations do not affect your statutory rights where a product is defective, materially different from its description, or otherwise does not conform to the sales contract.

6. Third-Party Brands and Intellectual Property

Product listings may refer to or depict third-party brand names, trademarks, designs, logos, or model references where applicable.

Unless expressly stated otherwise, AmberSole does not claim to be an authorised retailer, manufacturer, distributor, licensee, sponsor, or official partner of any third-party brand mentioned on the website.

Third-party trademarks and intellectual property remain the property of their respective owners.

Nothing in these Terms grants AmberSole or its customers any licence or ownership right over third-party intellectual property.

AmberSole intends to operate in accordance with applicable intellectual property laws. If a rights holder believes that content or a product listing on our website infringes its rights, it may contact us through the contact information provided on our website.

7. Accuracy of Information and Errors

We make reasonable efforts to ensure that information on our website is accurate and current.

However, occasional errors may occur in relation to:

  • Product descriptions;
  • Prices;
  • Promotions;
  • Availability;
  • Images;
  • Shipping information;
  • Estimated delivery times.

Where an obvious pricing, technical, or availability error occurs before a contract is concluded, we may correct the error and ask you to confirm whether you still wish to proceed with the order.

If an order cannot lawfully or reasonably be fulfilled because of an error and is cancelled, any amount already paid for that order will be refunded using the original payment method.

8. Orders and Contract Formation

Submitting an order constitutes an offer to purchase the selected products.

Receipt of an automated order confirmation does not necessarily mean that your order has been finally accepted where additional verification is required.

We may refuse or cancel an order for legitimate reasons including:

  • Product unavailability;
  • Obvious pricing or listing errors;
  • Suspected fraud;
  • Payment failure;
  • Incorrect customer information;
  • Legal or regulatory restrictions;
  • Inability to deliver to the specified destination.

If we cancel an order after payment has been received, we will issue the appropriate refund.

9. Customer Information

You agree to provide accurate, complete, and current information when placing an order.

This includes your:

  • Name;
  • Email address;
  • Telephone number where required;
  • Billing information;
  • Shipping address.

You are responsible for reviewing your shipping details before submitting an order.

If you notice an error after placing an order, please contact us as soon as possible. We cannot guarantee that changes can be made after fulfilment or dispatch has begun.

10. Payments

We accept the payment methods displayed at checkout.

Unless otherwise stated, payments are processed in euros (EUR / €).

Payment may be processed by independent third-party payment providers.

Your use of a payment method may also be subject to the terms and privacy policies of the relevant payment provider.

Where your payment account is denominated in another currency, your bank or payment provider may apply currency conversion rates or additional fees. These charges are determined by the relevant financial institution and are not controlled by AmberSole.

11. Fraud Prevention

Orders may be subject to security and fraud-prevention checks.

Where reasonably necessary, we may request additional information to verify an order or payment.

We may refuse or cancel transactions where we reasonably suspect:

  • Fraud;
  • Unauthorised payment use;
  • Chargeback abuse;
  • Identity misuse;
  • Other unlawful or suspicious activity.

Any fraud-prevention processing of personal data is subject to our Privacy Policy and applicable data protection law.

12. Shipping and Delivery

Shipping options and estimated delivery times are provided on our website, at checkout, or in our Shipping Policy.

Delivery estimates are estimates unless a specific delivery date has been expressly agreed.

Where no other delivery period has been agreed, goods will be delivered within the period required by applicable consumer law.

Under EU consumer rules, where no different delivery time has been agreed, traders are generally required to deliver goods without undue delay and no later than 30 days after conclusion of the contract.

If delivery is delayed, your rights will be determined in accordance with applicable consumer law.

13. Risk During Delivery

Where AmberSole arranges delivery to a consumer using a carrier selected by us, the risk of loss or damage generally remains with the trader until you, or a third party designated by you other than the carrier, receives the goods, except where applicable law provides otherwise.

If you independently instruct a carrier that was not offered by AmberSole, different rules may apply.

14. Right of Withdrawal

If you are an eligible consumer purchasing online within the European Union or another jurisdiction providing equivalent rights, you generally have the right to withdraw from your purchase within 14 calendar days without giving a reason.

For goods, the withdrawal period generally begins when you, or a third party designated by you other than the carrier, takes physical possession of the goods.

Further information about how to exercise this right is available in our Returns & Refund Policy.

Nothing in our voluntary return policy limits your statutory right of withdrawal.

15. 30-Day Return Policy

In addition to statutory withdrawal rights, AmberSole may offer a voluntary 30-day return period for eligible products, subject to the conditions stated in our Returns & Refund Policy.

Conditions applicable to voluntary returns may include requirements relating to the condition of the footwear, packaging, and signs of use.

These additional commercial conditions do not restrict rights that cannot lawfully be limited under consumer protection legislation.

16. Return Shipping Costs

Where a customer exercises the statutory right of withdrawal, the customer may be responsible for the direct cost of returning the goods where this was properly disclosed before the purchase and applicable law permits it.

Where goods are defective, damaged, incorrect, or otherwise non-conforming, AmberSole will bear costs where required by applicable consumer law.

17. Refunds

Approved refunds are generally returned to the original payment method in EUR (€).

Where a statutory right of withdrawal applies, reimbursement will be processed within the legally required period and subject to the conditions permitted by applicable law.

We may, where legally permitted, withhold reimbursement until we have received the returned goods or you provide evidence that the goods have been sent back, whichever occurs first.

Your payment provider or financial institution may require additional time to reflect the refunded amount in your account.

18. Legal Guarantee and Product Conformity

Products sold to consumers are subject to applicable statutory conformity and guarantee rights.

Under EU consumer rules, new goods are generally covered by a minimum two-year legal guarantee if they are defective or do not conform to the sales contract.

Depending on applicable law and the circumstances, consumers may be entitled to remedies including:

  • Repair;
  • Replacement;
  • Price reduction;
  • Termination of the contract and refund.

These statutory rights apply independently of any commercial warranty that may be offered.

19. Warranty Disclaimer

Nothing in these Terms excludes or limits any guarantee, warranty, condition, remedy, or consumer right that cannot lawfully be excluded or limited.

Subject to those mandatory rights, we do not guarantee that the website will always be uninterrupted, error-free, or continuously available.

Temporary interruptions may occur due to maintenance, updates, technical issues, security measures, or circumstances outside our reasonable control.

20. Limitation of Liability

Nothing in these Terms excludes or limits liability where such exclusion or limitation is prohibited by law.

In particular, these Terms do not seek to exclude liability for matters that cannot legally be excluded under applicable consumer law.

To the maximum extent permitted by law, AmberSole will not be responsible for losses that were not reasonably foreseeable when the contract was entered into or that result from circumstances outside our reasonable control.

If you are purchasing as a consumer, nothing in this section affects your mandatory statutory rights.

21. Customer Reviews, Comments, and Submissions

If you submit reviews, comments, photographs, feedback, suggestions, or other content to AmberSole, you confirm that you have the right to submit that content.

You must not submit content that:

  • Infringes intellectual property rights;
  • Violates privacy or data protection rights;
  • Is unlawful or fraudulent;
  • Is defamatory or threatening;
  • Contains malware or malicious code;
  • Misleads other users.

Where you voluntarily submit content for publication, you grant AmberSole a non-exclusive licence to use, reproduce, display, and publish that content for purposes connected with operating and promoting the Services, subject to applicable law.

We may remove content where we reasonably believe it violates these Terms or applicable law.

22. AmberSole Website Intellectual Property

Content created or lawfully licensed by AmberSole for the operation of the website, including original text, graphics, layouts, photographs, software, and other materials, may be protected by copyright, trademark, and other intellectual property laws.

You may not reproduce or commercially exploit AmberSole-owned content without permission, except where permitted by applicable law.

This provision does not claim ownership of trademarks, logos, designs, photographs, or other intellectual property belonging to third parties.

23. Privacy and Personal Data

The processing of personal data through the Services is governed by our Privacy Policy.

Where the General Data Protection Regulation ("GDPR") or other European privacy legislation applies, personal data will be processed in accordance with the rights, principles, and lawful bases described in that policy.

24. Cookies

Our website may use cookies and similar technologies.

Where required by applicable European privacy law, non-essential analytics, advertising, or tracking technologies will only be activated after appropriate consent.

Additional information is available in our Privacy Policy and any Cookie Policy or cookie consent tool made available on the website.

25. Third-Party Services and Links

The Services may contain links to or integrations with independent third-party services, including:

  • Payment providers;
  • Shipping carriers;
  • Social media platforms;
  • Analytics providers;
  • Other websites.

Third-party services are governed by their own terms and privacy practices.

AmberSole is not responsible for the independent content or practices of third-party websites, except where liability cannot lawfully be excluded.

26. Prohibited Uses

You must not use our website or Services:

  • For unlawful or fraudulent purposes;
  • To violate applicable laws or regulations;
  • To infringe intellectual property rights;
  • To impersonate another person;
  • To submit deliberately false or misleading information;
  • To transmit malware, viruses, or malicious code;
  • To gain unauthorised access to systems or accounts;
  • To interfere with website security;
  • To scrape or harvest personal information unlawfully;
  • To engage in spam, phishing, or similar abusive practices;
  • To interfere with the normal operation of the Services.

We may restrict or terminate access where reasonably necessary in response to violations of these Terms.

27. Account Suspension or Termination

If customer accounts are available, we may suspend or terminate an account where we reasonably believe that:

  • These Terms have been materially violated;
  • The account is being used fraudulently;
  • The account presents a security risk;
  • Suspension is required by law.

Termination or suspension does not affect rights or obligations that arose before termination, including existing consumer rights relating to purchases.

28. Events Outside Our Reasonable Control

We will not be responsible for delays or failures caused by circumstances outside our reasonable control to the extent permitted by law.

Such circumstances may include serious transport disruption, natural disasters, governmental actions, major network failures, or other exceptional events.

This clause does not remove rights available to consumers where an order is not delivered within the legally applicable timeframe.

29. Severability

If any provision of these Terms is found to be unlawful, invalid, or unenforceable, that provision will be interpreted or removed only to the minimum extent necessary.

The remaining provisions will continue to apply where legally possible.

30. No Waiver

If AmberSole does not immediately enforce a provision of these Terms, this does not mean that we waive the right to enforce it later.

This provision does not affect mandatory consumer rights.

31. Changes to These Terms

We may update these Terms from time to time to reflect changes to:

  • Our Services;
  • Business practices;
  • Technology;
  • Legal or regulatory requirements.

The latest version will be published on this page with an updated revision date.

Changes will not retroactively remove statutory rights or materially alter an existing purchase contract where doing so would be prohibited by applicable law.

32. Governing Law and Consumer Rights

These Terms are governed by the law applicable to AmberSole, subject to mandatory consumer protection rules.

If you are a consumer resident in the European Union or European Economic Area, nothing in these Terms deprives you of mandatory protections available under the law of your country of habitual residence where those rules apply.

Nothing in these Terms requires a consumer to waive any right to bring proceedings before a court that has jurisdiction under applicable law.

33. Dispute Resolution

If you have a complaint or dispute relating to an order, we encourage you to contact AmberSole Customer Support first so that we can attempt to resolve the matter directly.

This informal process does not prevent you from exercising any statutory right, contacting a competent consumer protection authority, or seeking judicial remedies available under applicable law.

34. Entire Agreement

These Terms, together with our:

  • Privacy Policy;
  • Returns & Refund Policy;
  • Shipping Policy;
  • Any other policies expressly incorporated into these Terms;

form the terms governing your use of the Services and purchases from AmberSole, subject to mandatory applicable law.

35. Consumer Rights

Nothing in these Terms is intended to exclude, restrict, or override consumer rights that cannot legally be waived.

If any provision of these Terms conflicts with a mandatory consumer protection requirement applicable to your purchase, the mandatory legal requirement will prevail.
